Simple Summary: read this first. This app is a wellness tool. It is not medical treatment. You must be 18 or older to use it. Do not use this app while driving or operating machinery. If you are in crisis, stop using the app and contact your local emergency services or a crisis support line immediately. If you install the app and give it to others, you are responsible for making sure they are 18+. We own the app. You can use it, but you cannot copy, sell, or modify it. The full rules are below.
1. What You Are Agreeing To
By downloading or using this app, you agree to these Terms. If you don't agree, don't use the app.
These Terms are a legal agreement between you and ProvenHERE, LLC.
We may update these Terms. When we do, we'll update the version number above and show a notice in the app. If you keep using the app after the change, you agree to the new Terms.
2. You Must Be 18 or Older
This app is for adults only. You must be 18 or older to use it.
By using the app, you confirm that you are 18 or older.
If you install the app and share it with others, including as a facilitator, NGO partner, or community organisation, you are responsible for making sure they are 18 or older. ProvenHERE, LLC is not responsible for misuse by people under 18 when the app is shared by a third party.
3. What This App Is and Is Not
3.1 What It Is
The HERE Foundation app gives you guided audio meditations, nature-based animations, soundscapes, and wellness exercises. It is designed to support general wellbeing and help manage stress.
3.2 This Is Not Medical Treatment
THIS APP IS NOT MEDICAL OR MENTAL HEALTH TREATMENT. It does not diagnose or treat any medical or mental health condition. It is not therapy.
If you have a medical or mental health condition, talk to a qualified health professional. Do not ignore their advice because of something in this app.
In an emergency, stop using the app and contact emergency services immediately.
3.3 Do Not Use While Driving
Do not use this app while driving, riding, or operating any machine that needs your full attention. Some content is designed to calm you down. This may slow your reactions.
4. If You Are in Crisis
If you are in danger or having a mental health crisis, stop using the app and contact your local emergency services immediately.
5. Your Right to Use the App
We give you permission to use the app on your own device for personal, non-commercial use. This permission is limited. We can take it back at any time.
You may not:
- copy, reproduce, or publicly display any part of the app, except that facilitators, NGO partners, and community organisations may share the app with end users for non-commercial use, with our permission;
- modify, reverse-engineer, or create other products based on the app;
- use the app for commercial purposes;
- remove any copyright or ownership notices from the app.
6. Research
You may not use this app to conduct research on users without our written permission. You also need users' separate informed consent before including them in any study.
This applies to facilitators, NGO partners, academic institutions, and any other third party.
7. Who Owns the App
ProvenHERE, LLC owns the app and all its content, including the audio, animations, designs, text, and the HERE and HERE Foundation names and logos.
Using the app does not give you any ownership rights. You may not use our name or logo without our permission.
8. Things You Must Not Do
When using the app, you must not:
- break any law;
- harm or threaten any person;
- try to access parts of the app or our systems that you are not meant to access;
- upload viruses or harmful code;
- scrape or extract data from the app in an automated way;
- pretend to be someone else;
- do anything that could damage our reputation or mission.
9. Other Websites and Services
The app may link to third-party websites and services. We do not control these sites. We are not responsible for what they contain.
We use Firebase Analytics (Google) and the app is distributed via the Apple App Store and Google Play. Your use of those platforms is subject to their own terms.
10. No Guarantees
We provide this app as-is. We make no promises about it.
We do not promise that the app will always work, be error-free, or be available at all times.
We do not promise that the content in the app is accurate or complete.
You use the app at your own risk. Some countries do not allow these limitations. In those places, the above applies as far as the law allows.
11. What We Are Not Responsible For
To the extent allowed by law, we are not responsible for any loss, harm, or damage that results from using or not being able to use this app. This includes indirect losses, lost data, lost income, or emotional distress.
The most we can ever owe you is the greater of: (a) what you paid to use the app (if anything), or (b) USD $50.
Nothing in this section removes our responsibility where the law does not allow us to limit it, such as if we cause death or injury through our own negligence, or if we commit fraud.
12. If You Cause Us Legal Costs
If your use of the app causes us to face a legal claim, you agree to cover our reasonable costs, including legal fees.
This applies to claims that come from: (a) your use of the app; (b) you breaking these Terms; or (c) you breaking any law.
13. We Can Stop the App
We can change, pause, or shut down the app at any time. We can do this with or without notice.
We can also end your access if we believe you have broken these Terms.
When these Terms end, Sections 7, 10, 11, 12, 15, and 16 continue to apply.
14. Events Beyond Our Control
Sometimes things happen that we cannot control, like natural disasters, power cuts, internet outages, or government actions. If something like this stops us from running the app, we are not responsible for the delay or disruption.
We will do our best to minimise the impact and let you know what is happening.
15. Which Laws Apply
These Terms are governed by the laws of California, USA.
If we have a dispute, we will first try to resolve it by talking. If that doesn't work, either of us can take the matter to the state or federal courts in Los Angeles County, California.
Either of us can go to court at any time for urgent matters, like stopping someone from using our intellectual property without permission.
No class actions. You agree to resolve any dispute with us as an individual. You may not join with other users to bring a group or class action.
If you live in the EU or UK, none of this takes away your right to go to court in your own country or rely on your local consumer protection laws.
16. US Sanctions
You confirm that your use of this app does not break any US sanctions laws. People or organisations on US sanctions lists may not use the app. We can end access for anyone who violates this rule.
17. General Rules
Full agreement. These Terms and our Privacy Policy are the full agreement between us.
If one part is invalid. If a court says one part of these Terms is not valid, the rest still applies.
No waiver. If we don't act on a rule right away, that doesn't mean we give it up.
Transfer. You cannot transfer your rights under these Terms to someone else without our permission. We can transfer ours.
Language. If we provide a translated version of these Terms, the English version is the one that counts if there's a conflict.

1. Who We Are
ProvenHERE, LLC ("we", "us", "our") owns and runs the HERE Foundation app. We are based at: 15335 Morrison Street, Ste 145, Sherman Oaks, CA 91403, USA.
HERE Global Foundation is a US non-profit (501(c)(3)). It shares the app with communities in need under a licence from us. The app is promoted at hereglobalrelief.org.

2. What This Policy Covers
This policy explains what data the app collects, how we use it, and what rights you have.
It only covers the HERE Foundation app. It does not cover other ProvenHERE products.
3. We Don't Know Who You Are
You can enter your name in the app for a personal greeting. That name stays on your device only. We never receive it or store it on our servers.
We don't collect your email address, phone number, or any other contact information.
We can't link your use of this app to you as a person. Your privacy is protected by design.
4. What Data We Collect
The app is built to work without internet. Here is what we collect and where it goes.
About emotional check-ins. Before and after every session, you have the option to check in with an emotional mood selector. This data is saved on your phone and shown on a graph in your Progress section.
If you decline to add your data to the Peace Map: your emotional check-in data stays on your phone only. The data is deleted when you use 'Clear All Data' in Settings or uninstall the app.
If you choose to add your data to the Peace Map: your selected emotions are sent to our servers with your general location after every session. Location is blurred to about 11 km / 7 miles. No name or ID is included. This data is anonymous and permanent. It cannot be deleted after it is sent. See Section 9.
In both cases, your emotional check-ins are never sent to Google.
Everything else stays on your phone only:
- Your name (if you enter one for a personal greeting), deleted when you uninstall the app or use 'Clear All Data' in Settings.
- Session logs, preferences, and notification settings, same as above.
- Your consent record (the date you agreed and the version number), stays on your phone. EU users: also survives 'Clear All Data' so we can keep honouring your preferences.
App usage data sent to Google (WiFi only, or cellular if you enable it in Settings): how long you used the app and which practices you opened. Your mood check-ins are never included. You can stop this at any time using the 'Send usage analytics' toggle in Settings. To delete data already sent, go to Settings > Device ID, copy your ID, and email it to peace [at] hereglobalrelief.org. EU users: off by default unless you opted in at first launch.
5. Why We Collect It
We collect data to make the app work, to improve it over time, and to build the Peace Map.
We never use your data for advertising. We never sell it.
5.1 If You Are in the EU, EEA, UK, or Switzerland. EU/EEA/UK privacy law (GDPR) requires us to explain both why we collect each type of data and the legal reason for doing so.
Peace Map data: We use it to add your contribution to the global Peace Map, showing how people feel around the world. Legal basis: your consent on the Peace Map screen.
App usage data (Firebase Analytics): We use it to understand how the app is being used and improve it. Legal basis: your consent. EU users must opt in; all users can change this in Settings.
Data stored on your phone: We use it to run the app, saving your progress, preferences, and sessions. This data never leaves your phone.
Emotional data may count as health data under EU privacy law (Article 9). We only collect it with your clear consent. We never send it to Google. We never link it to your identity.
6. How We Use Data to Improve the App
We use anonymous, combined data to understand how people use the app. This helps us make it better.
We never link this data to individual people. We look at patterns, not people.
Sometimes we run formal research studies. If you are invited to join one, we will explain the study and ask for your separate consent before including you.
Facilitators and partner organisations cannot use this app to conduct research on users without our written permission and without getting users' informed consent first.
7. Why We Don't Send Emotion Data to Google
We made a firm decision: we do not send emotion data to Google Firebase Analytics.
If we did, Google would build a long-term record of how each device's owner was feeling over time. Many of our users are trauma survivors or people in vulnerable situations. We think that risk is too high.
Emotion data from the Peace Map goes to our own server only, and not to Google.
8. Third-Party Services We Use
We do not sell your data to anyone.
8.1 Google Firebase Analytics. We use Firebase Analytics to count sessions and see which practices people use. Google LLC runs this service in the USA.
Each analytics event includes an anonymous device ID, the same ID shown in Settings. This is not your name or any personal detail. It exists solely so you can request deletion of your specific data by sharing it with us.
EU users: Google only gets your data if you opted in. We use a special legal agreement (called Standard Contractual Clauses) that protects your data when it travels to the USA. This is required under EU law after a ruling called Schrems II.

8.2 Amazon Web Services (AWS): Peace Map Server. Our Peace Map server runs on AWS in the USA (Virginia). Peace Map data has no name or ID attached. AWS acts as a service provider under a data agreement with us.
8.3 Apple and Google: App Stores. Apple and Google distribute the app through their stores. They may collect their own technical data as distributors. We do not receive personal data from them.
9. Peace Map: Your Data Is Anonymous and Permanent
Please read this before using the Peace Map.
When you choose to add your session data to the Peace Map, we send your emotion choice and your general location to our server. Your location is blurred to about 11 km / 7 miles. We do not send your name, your user ID, or your device ID.
Because the data has no identifier, we cannot find your specific entry later. We cannot delete it. This is intentional. The data is truly anonymous.
You are told this before you consent. Adding your data is always your choice.
For EU users: because this data has no information that identifies you, it is not personal data under EU privacy law (GDPR Recital 26). Your right to delete data does not apply to these entries. We are telling you this so you can make an informed choice.
10. How Long We Keep Data
- On-phone data: until you use 'Clear All Data' in Settings or uninstall the app.
- Your consent record: stays on your phone. EU users keep this even after 'Clear All Data'.
- Firebase Analytics: Google keeps this for up to 14 months. We set it to the shortest time possible.
- Peace Map data: kept forever as anonymous data. Cannot be deleted.
11. Your Rights
11.1 EU / EEA / UK / Switzerland. If you are in these regions, you have these rights under GDPR:
- See your data. Ask what we hold about you.
- Fix your data. Ask us to correct errors.
- Delete your data. Use 'Clear All Data' in Settings to delete everything stored on your phone. To delete your Google Analytics data, go to Settings > Device ID, copy your ID, and email it to peace [at] hereglobalrelief.org. We will submit a targeted deletion request to Google. Peace Map entries are anonymous and cannot be deleted.
- Limit how we use it. Ask us to pause how we use your data while we sort out a complaint.
- Move your data. Ask for a copy of your data in a common format.
- Object. Object to how we use your data.
- Change your mind. You can turn analytics on or off at any time using the 'Send usage analytics' toggle in Settings. All users have this toggle. Turning it off stops any future data being sent. It does not affect data already sent.
We can't contact you directly because we don't have your contact details. To use these rights, email us at peace [at] hereglobalrelief.org. We will reply within 30 days.
You can also complain to your local data protection authority. Find yours at edpb.europa.eu. In the UK, contact the ICO (ico.org.uk).
11.2 California (CCPA). If you live in California, you have these rights:
- Know. Ask what personal data we have collected.
- Opt out. Use the 'Send usage analytics' toggle in Settings to stop analytics being sent.
- Delete. Go to Settings > Device ID, copy your ID, and email it to peace [at] hereglobalrelief.org. We will submit a deletion request to Google. Peace Map entries are anonymous and cannot be deleted.
- Correct. Ask us to fix errors.
- No sale. We do not sell personal data.
- No discrimination. We treat all users the same, no matter what rights they use.
To make a California rights request, email peace [at] hereglobalrelief.org with the subject line 'California Privacy Request'. We will reply within 45 days.
12. If There Is a Data Breach
A data breach is when someone gets access to data they shouldn't have.
Because we don't collect your name or contact details, we can't contact you directly if a breach happens.
If there is a serious breach, we will: tell the relevant data protection authority within 72 hours, as required by law; and post a notice on hereglobalrelief.org.
Most of your data stays on your phone and is not at risk from a server breach. Peace Map data has no identifier, so even if it were exposed, it could not be linked to you.
13. Security
We take steps to protect your data. Data on your phone is stored using secure local storage. Data sent to our servers and to Google travels over an encrypted connection (HTTPS).
No system is perfect. We cannot promise that data will never be exposed. But we do our best to protect it.
14. Children
This app is only for people 18 and older. We do not knowingly collect data from anyone under 18.
15. Offline First
The app is built to work without internet. Here is what this means for your data:
- Data only goes to external servers when you are on WiFi (or cellular, if you turn that on in Settings).
- All data is saved on your phone first.
- You don't need an account. We don't ask you to register.
- We detect whether you are in the EU using your phone's language settings. We make no internet request to do this.
16. If the Business Changes Hands
If ProvenHERE, LLC is ever sold, merged with another company, or wound down, your data may be transferred to the new owner as part of that process.
If that happens, your data will continue to be handled under this Privacy Policy. We will post notice of any material change to how data is handled on hereglobalrelief.org.
17. Changes to This Policy
We may update this policy. When we do, we update the version number and date at the top.
If we make a big change, one that affects how we collect or use your data, the app will show a new consent screen when you next open it.
Small changes (like fixing a typo) will just appear here without a new consent screen.
